What is useful to have in front of you on a first call.

None of this is required. A call with none of it is still a useful call, and assembling it afterwards is normal.

If you have them

  • Any patent numbers you have been given, exactly as printed.
  • The date anything arrived, and how it arrived.
  • A plain description of what your product does, in the words your own engineers would use.
  • Whether a deadline has been stated to you, and by whom.

If a deadline is close, say so at the start of the call rather than at the end of it.

What should not be sent before there is an engagement.

Confidential material, trade secrets, source code, privileged documents and detailed facts about a live dispute should wait. Not because they are unwelcome, but because a conflicts check has to happen first, and until it does no protection exists for what you send.

A first message can safely say who you are, what industry you are in, roughly what happened, and whether there is a date. That is enough to work out whether a conversation can happen at all.
